Conservation Commission Minutes 6/12/06
CONSERVATION COMMISSION
Town of Monterey, Massachusetts

                                                                        
MEETING DATE: June 12, 2006

Present: David Dempsey, chair, Christopher Blair, Timothy Lovett, Judith Bach and Rick Andrus

The meeting convened at 6:00p.m.

6:05 – 6:15pm Schmerler – 27 Lime Rock Lane, RDA repair existing dock and ordinary repairs to existing decks attached to house
Scott Jenssen, representative for the Schmerlers presented the details of the work to be performed.  A motion was made by Tim Lovett to approve it as an N3 and was seconded by Rick Andrus.  

6:15 – 6:30pm Calzolaio –60 Swann Rd – RDA Build an 18x24 attached screen deck off rear gable of house
Scott Jenssen, representative for the Calzolaio’s presented the details of the work to be performed.  There are 2 man made ponds within 100feet of the project.  They are about 6 feet deep and purely ornamental.  The DEP’s definition of a pond was reviewed.  Dave Dempsey made a motion to approve it as an N3 and this was seconded by Tim Lovett.

6:31 – 6:51pm and 7:11 - 8:01pm - Lombardo – Pixley Rd – NOI 230-0231 – Replacement of previously existing block foundation with cast in place concrete foundation at two single family homes.  Installation of decks at each structure.
Ann Bruzzi from Berkshire Engineering, representative for Mr. Lombardo presented the plans and details of the work to be performed.  This is at the site formerly known as Blue Heron Landing.  There is a perennial stream off to the east as well as the lake and it’s located in a flood plain.  Ann states that they are under the 10% allowable threshold.  This plan with the decks will not pass the zoning bylaws as it is currently drawn up.  Chris Blair made a motion to approve the project as submitted and it was seconded by David Dempsey with the following conditions: 1. All work will be restricted to placing the new foundation underneath the existing living spaces not including the carport.  2. No decks, stairs or piers/foundation for decks be constructed.  3. An engineer needs to provide compensatory storage calculations for the new foundation beyond the previously existing foundation and creation of compensatory storage should be on the property.  4. Silt fences shown on the drawing are sufficient.  5. If dewatering of the foundation trench is necessary, the applicant shall provide a dewatering filtration basin 50 feet or more from the lakeshore.  The location shall be approved by a representative of the Conservation Commission onsite with the engineer.  The construction of the filtration basin shall be a combination of silt fence and stacked hay bails of sufficient size to manage the volume of water without overflowing the top.  6. Stock pile materials should be placed out of the 100ft buffer and covered with sheet plastic at the end of each work day.  Waiting on numbers from Berkshire Engineering before issuing paperwork.



6:53 - 7:10pm - Zellman/Gordon – 39 Tyringham Rd – RDA – construction of a 12x16 shed in the buffer zone of Lake Garfield
Dan Robinson, representative for the Gordon/Zellman property presented the details of the work to be performed.  The board reviewed the DEP wetlands map on the website for this address.  Chris Blair made a motion to approve it as submitted as an N3 and this was seconded by David Dempsey.

8:02 - 8:30pm
A representative for Diane’s Trail came in to discuss maintenance of the trail and replacement of a bridge.  They would like to do the work early next year.  A plan showing the design of the bridge would be necessary.  An abbreviated NOI application was provided.

8:30 – 8:32pm Fainer – Main Rd – SMANOI SMA06-11 – clear a driveway site, install driveway and drains and landscape disturbed area
This hearing was opened and continued until the July 10th meeting at 6pm due to the notification to abutters being done incorrectly.

For Discussion:

1.      Mail was reviewed.
2.      Minutes from May 8, 2006 were approved as written.
3.      The ZBA packet for Brenner at 42 Elephant Rock Rd was reviewed and a letter was drafted.
4.      The highway superintendent’s concerns over the amount of trees taken down at the Alpert residence on Mt Hunger Rd were discussed.  The board will make a site visit and call Mr. D’Alessio requesting his presence to review the no disturb zone depicted on his planting plan dated March 2006 to meet on Tuesday June 20th at 8am, call the board and remind them.
5.      The complaint from M. Oislander and maps associated with the property were reviewed.  M. Oislander needs to send us the whole drawing sheet prepared by KGP to document the location (only a section was provided to us).  She should make an appointment for a site visit at her earliest convenience (call David Dempsey to set up her appointment).
